Residential mobile homes and park home sites
The Mobile Homes Act 2013 amended the Caravan Sites and Control of Development Act 1960 to provide greater protection for residents of permanent mobile homes and caravans, particularly those on larger commercial Park Home sites. Further information on mobile homes is available here.
The new Act deems residential sites to be 'Relevant Protected sites'. If you are unsure whether your site is a Relevant Protected site please contact us. These additional requirements only apply to Relevant Protected Sites. All sites require a Site Licence
I operate a Mobile Park Home site, what else is required from me?
- You must set down Site Rules and lodge them with the council (existing site rules not lodged with the council before 3 February 2015 cease to have effect);
- Pay a fee for a new licence; to transfer or vary a licence, to lodge Site Rules and for annual inspections. (Owners can't pass on fees to site residents);
- You and/or your Manager must be a fit and proper person
I have one or more mobile homes on my site that I rent out on a permanent basis, what else do I need to do?
- You're operating on the same basis as a Mobile Park Home site and need to do the same
I have more than one mobile home on my site that are permanent homes for my staff, what else do I need to do?
- You're operating on the same basis as a Mobile Park Home site and need to do the same
I own and occupy my mobile home, what else do I need to do?
- You don't need to set down Site Rules or lodge them with the council unless there is more than one mobile home on your site.
- Pay a fee for a new licence, to transfer or vary a licence but NOT for annual inspections.
My site is only used by members of my family and we all live here permanently, what else do I need to do?
- You must set down Site Rules and lodge them with the council (existing site rules not lodged with the council before 3 February 2015 cease to have effect);
- Pay a fee for a new licence; to transfer or vary a licence, to lodge Site Rules but NOT for annual inspections.
- You must be a fit and proper person
What are Site Rules?
- Site Rules manage the behaviour of owners and residents and are a binding agreement.
- You must consult your residents before adopting Site Rules.
- Some rules are banned, e.g. site owners can't prevent home owners from selling their property or making improvements
- The council doesn't enforce Site Rules but some rules may be a duplicate of Site Licence conditions which are enforceable.
How do I set up site rules?
- There is a set process to follow for consultation laid down in the Mobile Homes (Site Rules)(England) Regulations 2014.

Can I still appeal against licence conditions?
- Yes. Appeals against site licence conditions for relevant protected sites are to the Residential Property Tribunal (rather than a Magistrate) in line with other Housing legislation.
What we will do?
- We will set down a Fee Policy which we will review annually - see Fees and Charges
- We will carry out annual inspections (except where exempt from an annual fee)
- We will use additional powers to secure compliance with site licence conditions.
- We will maintain and publicise a register of site licences and site managers.
How do I pay my Licence fee?
How do I lodge my site rules?
- Once you have completed the consultation process you need to send us a copy of your Site Rules at least 28 days and no later than 42 days after you have served your consultation response document.
- You need to enclose a cheque for the lodgement fee made payable to North Warwickshire Borough Council. Please ensure you provide details of your site on the reverse of the cheque - see Fees and Charges
How do I pay my annual fee?
- Annual fees for existing sites are due from 1st March. We will contact existing site owners for an inspection and issue an invoice.
- We will invoice you annually on the anniversary of the date your licence was issued (new applications) or on the 1st March each year (existing sites).
- Payments may be made debit or credit card by telephoning 024 7637 6188. Please ensure you provide a reference number when paying any fees.
