Anti Social Behaviour (ASB) Case Review

(Formerly known as Community Trigger)

Measures have been put in place from October 2014 under the Anti Social Behaviour, Crime and Policing Act 2014 which are designed to give victims and communities a say in the way anti social behaviour is dealt with:

The review, gives victims and communities the ability to request a review of their case and bring agencies together to take a joined up, problem solving approach to find a solution.

If you have reported Anti-Social Behaviour and you feel that insufficient action has been taken to resolve the matter, tell us about it under the ASB Case Review.

The review is designed to ensure that there is a review where cases have been reported and no action has been taken. It is not a complaints procedure.

Criteria for an ASB Case Review:

An individual has reported three separate incidents relating to the same problem in the past six months to the Council, Police or their landlord, and feel that insufficient action has been taken to resolve the matter.

OR

At least three people have made reports about the same problem in the past six months to the Council, Police or their landlord and feel that insufficient action has been taken to resolve the matter.

Please provide details about the problem you have reported previously and why you feel that insufficient action has been taken to resolve the problem. Please supply enough information to help us assess if the threshold for a review has been met. This can include the following:

  1. Your name
  2. Your telephone number
  3. Your email address
  4. Your address
  5. What anti social behaviour problem have you reported previously
  6. Provide details of incidents you have reported and to which organisation
  7. Provide any further comments you wish to make to support your request for a review
  8. Do you give consent for your information being shared with other relevant partners including the Police

The information you provide will help us decide if the threshold for a review has been met or if any other option to help resolve the problem needs to be considered. You should receive an acknowledgement of receipt of your request within 5 working days. A reply to your request will normally be answered within 28 working days. In some circumstances the request will need to be considered with other responsible authorities. Any information you provide will be processed in line with our Data Protection Policy and will only be held in line with our Records, Retention and Disposal Policy and schedules.

Sharing Information

We may disclose information to other partners where it is necessary, either to comply with a legal obligation, or where permitted under Data Protection legislation, example: where the disclosure is necessary for the purposes of the prevention and/or detection of crime.

Where we need to disclose sensitive or confidential information such as medical details to other partners, we will do so only with your prior explicit consent or where we are legally required to.

We may disclose information when necessary to prevent risk of harm to an individual

All of our processes for sharing information will be in line with the Warwickshire Sharing Information Protocol.

Appeals Process

If applicants are not satisfied with the outcome of a review into their case or the decision that they didn’t meet the trigger threshold, they have a right of appeal.

For cases in North Warwickshire, Nuneaton and Bedworth, Stratford and Warwick, appeals should be made to the Office of the Police and Crime Commissioner (OPCC). The OPCC’s office email is opcc@warwickshire.gov.uk.
