Land South-West of Heanley Lane, Hurley (Formerly Wrens Nest Site)
The Council obtained a High Court Injunction on this site on Friday 22nd May 2026, prohibiting any further development of the land Land South-West of Heanley Lane, Hurley (Former Wrens Nest Site) | Planning Injunctions | North Warwickshire Borough Council. The injunction was breached over the weekend and bank holiday. Consequently, the Council will be returning to court with the objective of prosecuting those responsible for the breach of the injunction. The unauthorised occupation also breaches an extant Enforcement Notice which covers part of the land. Court proceedings will also be taken in respect of the Enforcement Notice.
The Council returned to the High Court on the 4th June 2026 for the published return hearing. The Courts have agreed to a status quo injunction, whilst the matter is continuing to be investigated. The updated Court Order is being drafted and will need to be sealed by the Court before it can be served on the relevant parties. For the interim period, the existing injunction remains in force. Further investigations are ongoing in addition to the breach of the injunction and extant enforcement notices.
